Why You Need a Trust-based Estate Plan

A trust-based estate plan protects your family by ensuring your wishes are carried out if something happens to you. It lets you:

    β€£
Avoid probate court and maintain privacy.

A properly funded trust allows your estate to avoid the public, lengthy, and often expensive probate process.

Without a trust, your estate may go through probate court, which can tie up assets for months or even years and expose your financial affairs to public record.

    β€£
Ensure your medical care follows your wishes.

Through your Healthcare Advance Directive, you choose a trusted person to make medical decisions if you're unable to do so.

This prevents family conflicts and ensures your care aligns with your preferences.

    β€£
Control who handles your finances if you are incapacitated.

With a Durable Power of Attorney, you choose someone you trust to handle your finances if you become unable to do so.

This avoids a public court process where a judge might appoint someone you wouldn't have chosen.

If you have young children, a trust-based estate plan also allows you to:

    β€£
Choose who will care for your children.

By executing a valid will, you can nominate a guardian who you believe would best care for your children.

Without this choice in place, a judge would appoint a guardian if both parents pass away.

    β€£
Protect and control your children's inheritance.

A trust lets you decide when and how your children receive their inheritance, based on their financial maturity. You can protect their assets from creditors and avoid court-appointed property management.

Without a trust, children receive their entire inheritance at 18, regardless of their readiness to manage it.
